Terms of Service
Last updated October 28, 2026. Written in plain English as a good-faith draft; it has not yet been reviewed by a lawyer.
1. Who we are
"Brassplate" ("we", "us") is a brand name used by [OWNER LEGAL NAME: placeholder until provided], an individual doing business as a sole proprietor in New York State. Brassplate is not a corporation or LLC. Contact us through the contact form. Mailing address: [POSTAL ADDRESS: placeholder until provided].
2. Free previews, made without being asked
We create preview designs for local businesses on our own initiative, without the business's prior request. A preview uses publicly available facts about the business (name, phone, address, hours, and wording from its own public website or listing) to show what a new site could look like. Every preview is labeled as an unofficial preview, states that Brassplate is not affiliated with, endorsed by or acting for the business, asks search engines not to index it, and uses clearly labeled sample photos, never the business's logo or photos without permission. Business names and marks belong to their owners and are used only to identify the business the preview was made for. Previews are free, create no obligation, and are deleted 30 days after we hear "no" or get no reply. Any business (or its owner or representative) can have its preview removed through the removal form; we take it offline within 1 business day, usually the same day.
3. Monthly plans and automatic renewal
Care is $79 per month and Growth is $149 per month. Both renew automatically every month, and you are charged each month until you cancel. The first charge is made on the day your site goes live (never before), and later charges on the same date each month. There is no setup fee and no minimum term. Before we take any payment, we show these terms next to the payment button and ask for your clear agreement, and afterwards we email you a confirmation you can keep. It restates the price, how often you're charged, and how to cancel.
4. How to cancel
You can cancel at any time, online, with no call needed: use the cancellation form, reply "cancel" to any of our emails, or use the card provider's self-service link in your receipt where available. Cancellation stops all future charges. Your site stays up until the end of the month you've already paid for, and we confirm the cancellation by email the same or next business day. Full details are on Refunds & cancellation.
5. Price changes
We'll email you at least 30 days before any price increase. We will either ask for your agreement to the new price before charging it, or, if you're charged the new price, let you cancel within 14 days and refund the unused part of that period on a pro-rata basis.
6. What's included
Hosting, SSL, daily uptime checks and the items listed for your plan on the pricing page. A "small edit" is a text, photo, hours, price or service change that takes under 30 minutes. Small edits are unlimited within reasonable everyday use, and we turn them around within 2 business days. Bigger changes are quoted first and done only with your OK. Business days are Sunday–Thursday plus Friday morning, New York time. We don't work from Friday afternoon through Saturday, and requests made then are handled the next business day.
7. "Own it" one-time purchase
$590 once, with no recurring charge. We hand over the finished site files for you to host anywhere. Later edits are $45 each, only if you ask. If you are on a monthly plan, you can buy the site outright at any time for $590 minus the monthly fees you've already paid (down to $0).
8. Ownership
You always own your business name, logo, text, photos and domain. On monthly plans, the site design and code are licensed to you while you subscribe. If you cancel without buying out, we take the site offline after the paid period and send you an export of your content. Sample photos in previews were generated for Brassplate and may be used on your site while you are a client. Fonts are open-source (SIL Open Font License).
9. Your responsibilities
You confirm you have the rights to the content you send us, that your business details are accurate, and that you'll use the site lawfully. You are responsible for your domain registration and renewals unless we agree otherwise in writing.
10. Payments and taxes
Payments are processed by our payment provider (Stripe or PayPal). We never see or store your full card number. Prices are in US dollars. If any tax applies to a sale, it is shown on the invoice before you pay.
11. Refunds
If you're unhappy within your first 30 days live, we refund your first month. The $590 one-time purchase is refundable within 14 days of handover if you haven't published the files. See Refunds & cancellation.
12. Availability and disclaimer
We work to keep sites fast and online, but we can't guarantee uninterrupted service, because hosting, DNS and the internet are partly outside our control. Apart from what these terms promise, the service is provided "as is".
13. Limitation of liability
To the fullest extent the law allows, our total liability for any claim about the service is limited to the fees you paid us in the 3 months before the claim, and we are not liable for lost profits or indirect or consequential damages. Nothing in these terms limits liability that cannot legally be limited, or any rights you have under consumer protection law.
14. Takedown and rights complaints
If you believe a preview or client site uses your name, text, image or trademark in a way you don't authorize, use the removal form. We take previews down within 1 business day and investigate client-site complaints promptly.
15. Disputes and governing law
If something goes wrong, contact us first. We'll try in good faith to resolve it within 30 days. These terms are governed by the laws of the State of New York. Any dispute that we can't resolve will be heard in the state or federal courts located in New York State, and either of us may use small claims court where eligible.
16. Changes
If we change these terms, we'll update the date above and, for active clients, email you at least 30 days before a material change takes effect.
